Bidder's, Seller's and User's agree that the terms listed below shall govern the online auction sale.
 
All User's are required to electronically register before listing a property or bidding on this site. All registration information the Bidder provides to the site shall be current, complete and accurate. Bidders must be 18 years of age or older.

Definitions of Words and Expressions

In these Terms and Conditions unless inconsistent with the context or otherwise specified the following definitions will apply to words and expressions:

1a.       "Affiliates" means ThePropertyDiscounter.com and our third party licensors;


1b.        "Services" means the content, features and functionality provided via this Website to facilitate the online auction through which ThePropertyDiscounter.com is used to auction/sell and or buy found Property;

1c.         "Terms and Conditions" means these terms and conditions as may be varied or amended from time to time and any additional terms and conditions or disclaimers with reference to or displayed on the Website whether by hypertext link or otherwise;

1d.          "Transaction" means any transaction effected through the Services including but not limited to the contract of purchase and sale between the Seller and the Buyer.


1e.           "Website" means this Virtual ThePropertyDiscounter.com online auction website located at http://www.ThePropertyDiscounter.com or any subsequent URL used buy us from time to time;

1f.             "We"/"Us/I" means ThePropertyDiscounter.com

1g.            "You" means the person accessing and using this Website and/or the legal entity you represent  during the course of employment or engagement by that entity.

Online Service

2.1               This Website acts as an online venue to allow ThePropertyDiscounter.com Seller's/User's to auction and sell Property (in accordance with applicable law and regulations) and to provide You with the opportunity to bid for and buy such property.

2.2               By accessing or using the Services You agree to be legally bound by these Terms and Conditions.  By registering to Sell or Bid/Buy you are acknowledging that you agree to these Terms and Conditions on the Website this site.  This means You certify that You accept these Terms and Conditions.

2.3               We reserve the right to change these Terms and Conditions at any time.  Amendments will take effect when posted on the Website.  The date of the Terms and Conditions are stated at the top of the Terms and Conditions.  The Terms and Conditions current at the start of a Transaction will apply until that Transaction is completed.  Your continued use of the Services after any amendments to the Terms and Conditions shall be deemed to constitute your binding acceptance of such amendments.

2.4               We reserve the right to modify or withdraw this Website (or any part) at any time without notice.

Participation in the Online Service

3.1               You can browse the Website at any time without registering.  To use the Services, You are required to register as a member by completing the online registration form on the Website and submitting it to Us by clicking on the "Register to Bid and Buy" link.  You should only register if You intend to buy or sell.  Registration to buy or sell and the use of the Website is free.

3.2               The Services are only available to individuals who are:

(a)               aged 18 years and over (and by registering and accepting these Terms and Conditions You represent to the buyers and sellers and ThePropertyDiscounter.com that You are not a minor and can form legally binding contracts under applicable law)

3.3               If You are registering on behalf of a business entity, You represent and warrant that You have authority to bind the entity to these Terms and Conditions.  Without prejudice to your warranty, ThePropertyDiscounter.com reserves the right to ask You for written authority from the business entity before registering any business entity.

3.4               You agree to ensure that your registration details are up to date and accurate and to update any details when necessary using the "Edit My Account" link on the Website.

3.5               You warrant and undertake to Us that all the information supplied to Us on the User Registration Form is true and accurate.

3.6               We reserve the right in our sole discretion to refuse any application to register and access the Services and to temporarily or indefinitely suspend any registered members.
 
3.7               BIDDING INCREMENTS: Our auction software may set bid increments automatically as an auction progresses.

3.8               BIDDING: Bidding is a binding legal contract in most states.  By placing a bid on ThePropertyDiscounter.com you agree that you will purchase the item for the amount of your bid should you be the high bidder at closing as acceptable to the seller. Bids may not be retracted except in the case of an obvious and grievous error in the bidding process.  If such an error has occurred, you must inform the Seller immediately by email and include a description of the error. The Seller at their sole discretion will make a ruling on the error and the decisions of Seller will be final. Bidding on the wrong property, changing your mind, or bidding a few dollars more than you wished are not grounds for bid retraction.  See also section 26.0  Disputes.

3.9               AUCTION CLOSINGS:  In an effort to level the playing field and give everyone an equal chance regardless of  equipment, internet connection speed, technical ability, or dexterity, auctions will end at the stated time unless there is bidding within the final 5 minutes of the auction.  In these cases, bidding will be extended until a 5 minute period where no bids have been received has elapsed. At that time, the auction will close. This is analogous to ThePropertyDiscounter.com giving fair warning at a live auction before dropping the hammer, and is different than most online auction systems. Therefore, we call this feature the ThePropertyDiscounter "Overtime bidding period".

3.10             Following the close of an auction, if you were the high bidder, you will be informed by email from the Seller of your winning bid.  You have 48 hours to contact  the Seller to arrange for payment and set up closing arrangements. If no contact is made between buyer and seller within 48 hours,  the Seller reserves the right to 1) extend the 48 hour timeline, 2) offer the item to the second highest bidder, 3) re-post the item for sale in a new auction, or 4) remove the item from the auction.

3.11             EMAIL NOTIFICATIONS:  ThePropertyDiscounter.com auction software is designed to automatically inform you by email of new property additions in markets you have indicated interest in and you agree to receive these automated emailings.  You agree to maintain a valid email address as part of your Registration Information at all times. If you change your email address, you must update your Registration Information on our system using the simple process to Change your Email Address on the "Edit my Account" page.  After submitting this form, you will receive a confirmation code by return email.  You then use the Confirm Changed Email Address Form and your confirmation code to complete your registration update. ThePropertyDiscounter is not responsible for you not receiving email notifications for any reason. Please ensure that the SPAM filter on your email program is set to accept email from  ThePropertyDiscounter.com. 



4                   
User Name and Passwords

4.1               You are solely responsible for keeping your personal user name and password secure and confidential. You should not share, display, disclose or permit your user name or password to be disclosed to any other party.

4.2               You are responsible for use of the Services when access to the Services is obtained through the use of your user name and password whether authorized or unauthorized.

4.3               You agree not to impersonate any other person or entity or use any false name or use any other person's user name and password to access the Services.

4.4               If you believe that Your user name and/or password has become known to another person or You are aware of any other breach of security regarding the Services, then You must notify Us immediately.

4.5               You agree and warrant that You will implement and comply with the above procedures.

4.6               We reserve the right to withdraw user names and passwords at any time without notice and in our sole discretion including but not limited to where We have reason to believe that such user name and password have been discovered and/or used by any person or organization other than You.

General rules governing bidding and buying

5.1               You can only make a bid and use the Services if You are registered.  You agree to comply with any instructions or notifications posted on the Website from time to time in relation to use of the Services.

5.2               All auctions will be conducted in US Dollars ("USD") unless stated in a particular auction.  You are responsible for ensuring that You have sufficient funds to cover the cost of Your bid and make payment in accordance with the applicable payment method.

5.3               Any bid that you make via this Website constitutes a legal offer to buy the item from the relevant Seller via ThePropertyDiscounter.com.  You may not retract a bid except for limited circumstances allowed under applicable law, for example, where the item does not materially comply with the description provided in relation to it on the Website.

5.4               ThePropertyDiscounter.com Auction  Sellers are entitled to set applicable minimum bids or reserve requirements and are entitled to change these during the auction period.  If an auction subject to a reserve ends and the reserve price is not met You and the relevant ThePropertyDiscounter.com Seller/Buyer are released from any obligation to complete the Transaction.

5.5               By bidding for an item you agree to be bound by any terms and conditions of sale included in the item's description on the Website.

5.6               Any bid you make will remain open for the time period specified on the Website. This Website does not support the practice known as "sniping" where bidders place bids within the final few minutes of an auction and do not allow other bidders time to respond.

5.7               The winning bid in any auction will be the first highest bid to be registered on ThePropertyDiscounter.com that exceeds the reserve price (if any) and meets the conditions that are specific to that Sellers auction conditions.

5.8               If you bid for an item via the Website, You acknowledge and agree that if You have placed the highest bid which is (where applicable) at or above any reserve price or minimum bid and the ThePropertyDiscounter.com Auction   has confirmed acceptance of your bid, You have entered into a legally binding contract to buy the item from that Seller.

5.9               ThePropertyDiscounter.com and or the Seller has full discretion to refuse to accept Buyers bid for whatever reason at any time.

5.10            ThePropertyDiscounter.com reserves the right to cancel or stop an auction at any time, such as where the Property displayed for auction is recognized by the rightful owner.

5.11            If your bid is successful you will be contacted by the relevant  Seller to confirm acceptance of your bid and the amount of the successful bid and details of the relevant items, payment method details and details for You to arrange for collection of the items from the ThePropertyDiscounter.com Auction.

5.12            Following the close of an auction, if you were the high bidder, you will be informed by email from the Seller of your winning bid.  You have 48 hours to contact  the Seller to arrange for payment and set up closing arrangements. If no contact is made between buyer and seller within 48 hours,  the Seller reserves the right to 1) extend the 48 hour timeline, 2) offer the item to the second highest bidder, 3) re-post the item for sale in a new auction, or 4) remove the item from the auction.

5.13            You agree to comply with all applicable Federal /State / Local laws, statutes and regulations concerning your use of the ThePropertyDiscounter.com Auction Services.

5.14            BUYER'S PREMIUM: Typically, there is NO buyer’s premium.  If an item has a buyer's premium, it should always be prominently displayed both during the preview, and during the auction in the item's description.

6                   
Payment

6.1               Payment for items can only be made by using the Terms and Conditions as set forth in each individual Auction.  We are not responsible for any third party services.

6.2               Details of the payment method will be provided to You by the relevant  Seller or Seller's designee.  Typically, settlement / downpayment for  purchases must be made by cashiers’ check or money order made payable to Seller or their designee or as agreed to.  All sales are subject to appropriate local, State, and Federal Tax Laws.
 

7                   
  Transfer of Property

7.1               Details relating to the property should be available to You upon request from the Seller.  The Seller should make inspection / moving terms and conditions available during the auction timeline.

7.2               You will at your own expense move mobile property You have purchased from the relevant Seller upon payment of cleared funds to Seller.  You are responsible for any removal, delivery, storage and insurance charges as outlined in the Seller's Terms and Conditions.



8                   
ThePropertyDiscounter.com's role

8.1               We have no involvement in any transaction between You and the Seller.  Our role is one of a facilitator to provide You with the opportunity to participate in the Service.  We are not a direct or indirect party to the contract of purchase and sale between the Buyer and the Seller’s Auction.

8.2               We do not post the items advertised for auction on this Website.  You acknowledge that We:

(a)               are not the owner of the properties being sold;

(b)               do not have authority to act for and are not an agent for any Buyer's or Seller’s Auction  ;

(c)               will only get involved with any dispute between You and Seller to the extent set out in our dispute resolution procedure in section 26.0;

(d)               do not routinely screen, monitor or assess the description, quality, safety or legality of items advertised;

(e)               are not responsible in any way if any property displayed and subsequently sold via this Website prove unsatisfactory.

8.3               We are not responsible for ensuring that the Buyer and Seller   complete a Transaction.

9                   
Returns

9.1               Other than as may be required under law, ThePropertyDiscounter.com   can not and will not under any circumstances accept the return of property.

9.2               Buyers are responsible for inspecting the property before the end of the bidding process to ensure that it matches the property described on the Website.


9.4               In the event of a dispute about a property, the Buyer and the Seller agree to follow the dispute resolution procedure set out in clause 26below.

9.5               You acknowledge that there is no other right to return or cancel property that You have purchased.

10               
Availability of the Website

10.1            You acknowledge that due to the nature of the Internet, We cannot guarantee that access to the Website will uninterrupted or that e-mails or other electronic transmissions will be sent to You or received by Us or that the content of such transmissions will be secure during transmission.

11               
Intellectual Property Rights

11.1            You are granted a limited licence to access and use this Website solely for the purposes of use connected with the Services.  All contents of this Website including, but not limited to, the text, graphics, links and sounds are owned by our third party licensors and may not be copied, downloaded, distributed or published in any way without their prior written consent, except that You may print, copy, download or temporarily store extracts for your personal information or when You use the Services.

11.2            You are not permitted to use any trademarks or service marks whether registered or unregistered of any of the ThePropertyDiscounter.com without prior written consent.  You may not frame or utilize framing techniques that include any proprietary information such as images, text or page layout without the prior written consent of our third party licensors.  You may not use any "metatags" or any other type of hidden text that uses any trade marks or service marks without prior written consent.

11.3            The "Virtual ThePropertyDiscounter.com" logo may be used by You royalty free with our written consent for related purposes, provided that such usage does not alter or bring the logo into disrepute or is otherwise in our sole discretion detrimental to Virtual ThePropertyDiscounter.com or the Services and an accreditation is shown to "Virtual ThePropertyDiscounter.com".

11.4            You agree not to copy, modify, download (other than page caching), store or sell any part of this Website without our prior written consent.

11.5            Any information provided by this Website may not be disclosed, reproduced, copied or sold for any commercial purpose other than for obtaining the Services via this Website.

11.6            In relation to any information, materials or other content that You submit to Us via this Website, You grant Us a non-exclusive, royalty-free, perpetual, irrevocable and fully sub-licensable right to use and reproduce such information, ideas, know-how, concepts, techniques and materials for any purpose, including without limitation, the copying, transmission, distribution and publication unless restricted by applicable law.  You represent and warrant that You own or otherwise control all of the intellectual property rights and information, materials or other content that You submit or post via this Website.

12.1            You agree that any and all personal information and data collected from You via this Website was part of the Services from time to time and may be used in accordance with our current Data Protection and Privacy Statement.

LIMITATION OF LIABILITY

13.1            NOTHING IN THESE TERMS AND CONDITIONS EXCLUDES OR LIMITS LIABILITY FOR DEATH OR PERSONAL INJURY, DISHONESTY, FRAUDULENT MISPREPRESENTATION, STATUTORY RIGHTS OF CONSUMERS THAT CANNOT BE WAIVED OR LIMITED BY CONTRACT OR OTHERWISE TO THE EXTENT PERMITTED BY APPLICABLE LAW.

13.2            SUBJECT TO THE DISPUTE CLAUSE:

(a)               WE MAKE EVERY REASONABLE EFFORT TO ENSURE THAT THEPROPERTYDISCOUNTER.COM PROVIDES ACCURATE, COMPLETE AND UP-TO-DATE INFORMATION ON THIS WEBSITE.  HOWEVER, THE WEBSITE AND SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS.  WE DO NOT MAKE ANY REPRESENTATION OR WARRANTY OF ANY KIND EXPRESS OR IMPLIED REGARDING THE CONTENTS OR AVAILABILITY OF THE WEBSITE OR SERVICES.

(c)               WE EXCLUDE ALL WARRANTIES, CONDITIONS, TERMS, UNDERTAKINGS AND REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, STATUTORY OR OTHERWISE IN CONNECTION WITH THE SERVICES AND THE WEBSITE TO THE FULLEST EXTENT PERMITTED BY LAW.

(d)               ANY SOFTWARE DOWNLOADED FROM THIS WEBSITE OR AS PART OF THE SERVICES IS AT YOUR OWN RISK AND WE DO NOT ACCEPT LIABILITY FOR ANY DIRECT OR INDIRECT LOSS OR DAMAGE HOWSOEVER CAUSED AS A RESULT OF ANY COMPUTER VIRUSES, BUGS, TROJAN HORSES, WORMS, SOFTWARE BOMBS OR OTHER SIMILAR PROGRAMS ARISING FROM YOUR USE OF THIS WEBSITE.  WHILE WE WILL DO OUR BEST TO ENSURE THAT THE WEBSITE IS FREE FROM SUCH DESTRUCTIVE PROGRAMS, IT IS YOUR RESPONSIBILITY TO TAKE REASONABLE PRECAUTIONS TO SCAN FOR SUCH DESTRUCTIVE PROGRAMS.

(f)                WITHOUT PREJUDICE TO THE ABOVE, IN ANY EVENT OUR LIABILITY SHALL BE LIMITED TO AN AMOUNT NOT EXCEEDING:

(i)               THE AMOUNT PAID OR PAYABLE BY YOU OR THE HIGHEST BIDDER TO THE SELLER FOR THE  PROPERTY TO WHICH THE CLAIM RELATES FOR ONE INCIDENT OR SERIES OF INCIDENTS ATTRIBUTABLE TO THE SAME CAUSE OR IF NO SUCH AMOUNT IS PAID OR PAYABLE THE MARKET VALUE OF SUCH ITEMS; OR

(ii)                WHERE NO AMOUNT IS PAID OR PAYABLE THE MAXIMUM SUM OF $10.00.

14               
User Indemnity

14.1            You agree to fully indemnify, defend and hold Us harmless immediately upon demand from and against all actions, liability, claims, losses, damages, costs and expenses (including legal fees) We incur arising directly or indirectly as a result of your breach of these Terms and Conditions, including without limitation any claim against Us by a ThePropertyDiscounter.com that you have not honored your commitments in respect of a Transaction.

Termination of the Service

16.1            We reserve the right in our sole discretion to:

(a)               discontinue any auction or bid and exclude You from using the Service where You are in breach of any of these Terms and Conditions;

(b)               suspend or discontinue the Service at any time.

Third Party Rights

17.1            These Terms and Conditions do not create any rights or benefits enforceable by any person not a party to it (within the meaning of the Contracts) except:

(a)               an Affiliate shall have the right to enforce any rights or benefits in these Terms and Conditions;

(b)               an Affiliate shall have the right to enforce the rights or benefits of any indemnity, limitation and/or exclusion of liability in these Terms and Conditions;

(c)               a person who is the permitted successor or assignee under clause 18.2 below of the rights or benefits of these Terms and Conditions may enforce such rights or benefits.

17.2            No consent from the persons referred to in this clause 17 is required to vary or rescind these Terms and Conditions (whether or not in a way that varies or extinguishes rights or benefits in favor of such third parties).

General Information

18.1            You may not use any part of the Website on any other website or link to the Website without our prior written consent, except that You may link to this Website provided that you do not misrepresent your involvement with this Website and that You do nothing in our opinion that may bring the Website into disrepute or in our sole discretion is detrimental to the Services.

18.2            We reserve the right to transfer, assign or sub-contract all or any of our rights and duties and responsibilities set out in these Terms and Conditions to another party.

18.3            Headings have been included for convenience only and will not be used in construing any provision of these Terms and Conditions.

18.4            No delay or failure by Us to exercise any powers, rights or remedies under these Terms and Conditions will operate as a waiver of them nor will any single or partial exercise of any such powers, rights or remedies include any other or further exercise of them.

18.5            If any provision of these Terms and Conditions shall be found by any court or administrative body of competent jurisdiction to be invalid or unenforceable the invalidity or unenforceability of such provision shall not affect the other provisions of these Terms and Conditions and all provisions not affected by such invalidity or unenforceability shall remain in full force and effect.

18.6            To the extent permitted by applicable law, these Terms and Conditions will be construed in accordance with and governed by the laws of the United States of America and each party agrees to submit to the exclusive jurisdiction of the courts of the United States of America.


18.7            SYSTEM INTERFERENCE:    You may not use any device, software or routine to interfere or attempt to interfere with the proper working of ThePropertyDiscounter.com website or any auction being conducted on our website. You may not take any action which imposes an unreasonable or disproportionately large load on our infrastructure.

18.8            SYSTEM INTEGRITY:    ThePropertyDiscounter.com system is offered "as is".  We do not guarantee continuous, uninterrupted or secure access to our services, and operation of our site may be interfered with by numerous factors outside of our control.  ThePropertyDiscounter.com makes no guarantees about its system's performance, and is not responsible for missed bids, missed or unsent email notices, general system failures, server downtime, or software errors.

18.9            AMENDMENT:    We may amend our Terms and Conditions at any time by posting the amended terms on our website.

 

19.0 Contract of Sale
                      

                The successful high bidders (Buyers) at each auction are bound by the written terms and conditions as publicized for each sale.  The Contract of Sale, which is executed immediately after the bidding, typically within 48 hours. The Offer to Purchase (Contract of the Sale) is available from the Seller in one of several ways, either online or at the open houses, by mail or fax. The act of bidding at the sale by anyone will be deemed a representation and warranty to the Seller that he/she has read the Bidder's written terms and conditions as publicized for each sale and has reviewed the Offer to Purchase (Contract of Sale) in it's entirety, together with any amendments and/or attachments, prior to bidding. Attachments to the Contract of Sale may include a Seller's Disclosure Form prepared by the Seller, Title Insurance Commitment prepared by a third party closing or title firm. If a potential bidder has not read and agreed to be bound by all of these documents prior to the auction, he/she should not bid.

 

 

 

20.0 Inspections

 

 


                All property including but not limited to Homes, Buildings and Vacant Property are generally open for viewing as scheduled by seller prior to the sale unless otherwise advertised. Vacant land and lots may be inspected at your convenience with seller permission. Registration may be required at Open Houses unless otherwise specified.  All properties are sold "AS-IS" (contracts are not contingent on any buyer or lender inspections unless agreed to by the seller) so Buyers should make any and all desired inspections during these viewing hours. All properties are made available solely at prospective buyers own risk and expense, including without limitation all dangers inherent, known, or unknown; and Sellers and TheProperty Discounter.com disclaim any "invitee" relationship which could be construed and therefore any liability incurred by any person inspecting, viewing, or attending the inspection of any property.

 

 

21.0 Title

 

 


A title insurance commitment for each property should be prepared and available prior to closing. The Seller warrants insurable title per the terms of the Contract of Sale, and will evidence same by obtaining the title insurance commitment from a third party title/closing firm identified in the Contract of Sale as amended. unless otherwise stated.  The third party title examiner issues the title policy, and Buyer is welcome to retain their own counsel to review title and/or policies. Prior to bidding, potential buyers should review and understand the restrictions and obligations placed on the Property, whether disclosed in the title commitment, Contract of Sale, or otherwise of record in city/county records or announced.  Such restrictions may be found at the county courthouse where the property is located, the county and city planning and zoning commissions or departments, and by consulting with an attorney. At closing, the Buyer shall be given insurable title as the property is transferred by a deed prepared by Seller, clear of liens or encumbrances (taxes, HOA dues, transfer fees, etc. will be prorated between the Buyer / Seller).  

 

 

22.0 Closing Costs

 

 


The Seller typically pays for certifying base abstracts (if necessary); curing any title defects (as determined by the third party title examiner); revenue stamps or other taxes customarily due from Seller upon filing of a deed; and 1/2 of the closing fee. The Buyer pays the third party title examination fee (typically $150-250); the title search fee (if required, typically $150); the title insurance premium (based on sales price, typically a minimum of $250 plus approximately $5 additional for each $1,000); and 1/2 the closing fee. Current year's real estate taxes are usually pro-rated through day of closing.  These costs to the Buyer will usually total a minimum of $1,500 (consult the Contract of Sale as amended for the auction and/or other documents or announcements regarding the sale for each property's specific instructions regarding closings costs and tax prorations). Potential Buyers and Sellers should consult his/her lender and/or the closing company for a more detailed estimate of closing costs.

 

 

23.0 Closing Date

 

 

Most auctions will require the Buyer to close (pay the balance of the purchase price plus closing costs) within 30 days from the date of the auction. Sellers will usually offer a Buyer reasonable extensions if more time is needed, but this decision is solely that of the Seller, and will include a per diem charge for each day the Buyer is late (.0005 x Sales Price Per Day, $150 per day minimum). By bidding, each potential Buyer is representing and warranting to the Seller, ThePropertyDiscounter.com, employees, and officers, that Buyer is accepting the Property in its current condition, including fixtures, equipment and appliances, or as agreed to by seller; is accepting the title per the title insurance commitment and is prepared to close with cash immediately.

 

 

24.0Down Payment

 

 

Most auctions will require the Buyer to make a cash or Certified Check deposit within 48 hours for at least 5% of the purchase price ($1,000 minimum) or in some instances 10% of the purchase price ($5,000 minimum). If for any reason Seller does not perform per the terms of the Contract, the sole remedy shall be the return of Buyer's down payment within five (5) business days.

 

 

  25.0 Financing

 

 

If a potential Buyer plans on using financing to close, then they should take all steps necessary to secure same prior to bidding, since ThePropertyDiscounter.com auctions should never be contingent on financing. 26.0 Disputes

 

 


  Your Contract of Sale should specify that the Buyer, Seller agree to submit any claim arising out of a dispute (within 180 days of the auction, or 30 days of closing, whichever is earlier; after this period, all  claims should reflect the statement that they are VOID per the Contract of Sale) to "binding arbitration governed by the rules and procedures of the American Arbitration Association."  This agreement to arbitrate binds the parties to resolve a dispute through the arbitration process rather than any legal proceedings. Most areas have, on occasion, experienced heavy rainstorms. There are areas where property has been damaged from overflow creeks, streams, rivers, and from run off water in areas where storm water drainage facilities were incapable of handling run off water fast enough to prevent flooding. Every potential Buyer should satisfy him/herself with the flood and water history and water risk attendant to the Property being sold prior to the auction. 30.0 Lot Lines, Easements and Dimensions

 

 


If a potential Buyer has any questions or material needs regarding exactly where lot lines, tract boundaries, or any easements are located, as well as the dimensions of land and/or buildings, Buyer may choose to have a staked survey made by a licensed surveyor prior to bidding at Buyer's expense. Buyer may request that the survey show the location of utility easements and driveways, proximity of buildings to lot lines, and the dimensions of improvements. 31.0Agency Relationships

 

 


A Seller who lists property for sale with a specific Broker establishes an agency relationship with that specific Broker, who as the Listing Broker are the "Seller's Agent". As the Seller's Agent act solely on behalf of the Seller. Seller's Agents do not represent the Buyer. This relationship is disclosed and confirmed in both the property packet,  and Contract of Sale (Contract).
